1. Acceptance of Terms

By accessing or using the dundunn platform ("Service") operated by dundunn LLC ("dundunn", "we", "us"), a Wyoming limited liability company, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

dundunn is a business operating system for independent professionals, currently offering:

Trading intelligence: market scoring, breadth analysis, AI-powered narratives and coaching
Trade management: journaling, position tracking, performance analytics
Broker integration: OAuth-based connections to brokerage accounts for data access and order execution
Fitness optimization: wearable data integration and cross-product performance correlation (coming soon)
Business management: expense tracking, document management, P&L reporting

3. NOT Financial Advice

IMPORTANT DISCLAIMER

dundunn LLC is a software company. We are NOT a registered investment advisor (RIA), broker-dealer, financial planner, or fiduciary.

We do not provide investment advice, portfolio management, or personalized financial recommendations of any kind.

Nothing in dundunn is a recommendation. All content displayed within dundunn — including but not limited to setup scores, confluence ratings, breadth signals, AI-generated narratives, trade setups, gameplan letters, coaching conversations, and any other analytical output — is provided strictly for informational and educational purposes only. No content in dundunn should be interpreted as a recommendation to buy, sell, or hold any security.

You make all trading decisions. dundunn does not trade autonomously, manage your money, or make decisions on your behalf. Every order submitted through dundunn is initiated, reviewed, and confirmed by you.

4. Risk Disclosure

TRADING RISK WARNING

Trading involves substantial risk of financial loss. You can lose some or all of your invested capital. Options and leveraged products carry additional risk. Past performance of any strategy, indicator, score, or setup shown in dundunn does not guarantee future results.

Only trade with capital you can afford to lose entirely.

You are solely responsible for evaluating whether any trade is appropriate for your financial situation, risk tolerance, and investment objectives.

5. Accounts and Eligibility

You must be at least 18 years old to use dundunn.
You are responsible for maintaining the security of your account credentials.
You must provide accurate information when creating your account.
One account per person. Account sharing is prohibited.
We reserve the right to suspend or terminate accounts that violate these terms.

6. Broker Integrations

Broker connections are made through OAuth 2.0 — we never access or store your broker login credentials.
You authorize dundunn to view your account data and submit orders on your behalf.
dundunn is not affiliated with, endorsed by, or sponsored by any brokerage.
You may revoke broker access at any time through dundunn settings or your broker's account settings.
dundunn is not responsible for broker outages, execution quality, fills, or any actions taken by your broker.

7. AI Features

AI-generated content is for informational purposes only and should not be relied upon as the sole basis for trading decisions.
AI features use credits included in your subscription tier or purchased separately.
AI outputs may contain errors, inaccuracies, or outdated information.
We are not responsible for trading decisions made based on AI-generated content.

8. Subscriptions and Billing

Paid subscriptions are billed monthly or annually through Stripe.
You may cancel your subscription at any time. Access continues until the end of the billing period.
We reserve the right to change pricing with 30 days notice to existing subscribers.
AI credit packs are non-refundable one-time purchases.
Refunds are handled on a case-by-case basis at our discretion.

9. Intellectual Property

The dundunn platform, including its scoring algorithms, setup classification system, UI design, and analytical methodology, is the intellectual property of dundunn LLC.
Your data (trades, notes, settings) remains yours. We claim no ownership over your content.
You may not reverse-engineer, copy, or redistribute dundunn's proprietary scoring or analytical systems.

10. Data and Market Information

Market data displayed in dundunn comes from your connected broker account and/or derived analytics computed from licensed data sources.
We do not guarantee the accuracy, completeness, or timeliness of any market data or analytics.
Derived analytics are computed values and may differ from other data sources.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUNDUNN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR TRADING LOSSES.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless dundunn LLC, its officers, and employees from any claims, damages, or expenses arising from your use of the Service, your trading activities, or your violation of these Terms.

13. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We are not liable for any losses resulting from service unavailability.

14. Termination

Either party may terminate this agreement at any time. Upon termination, your right to use the Service ceases immediately. You may request export of your data before or within 30 days of termination.

15. Governing Law

These Terms are governed by the laws of the State of Wyoming. Any disputes shall be resolved in the courts of Wyoming.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use after changes constitutes acceptance.
